A really good logical problem

A motorist is driving through a short black road. His headlights aren't working. There are no street lights and moonlight. Despite all these, the motorist succeeded not to hit any person, that is dressed in black and is walking in the middle of the road. How did the motorist succeed doing this?

Despite being all dark, nowhere is said to be night. So it's logical for us to coclude that the situation happens during the light part of the day and that's the reason the motorist could see the person.

1. Assuming it could actually be night, and that everything is pitch black. The actual probability that both the motorist and the person walking in the middle of the road are at the same exact time in the same exact spot of the road are pretty damn low.

2. Because the motorist is driving on the right/left side of the road while the person is walking in the middle of the road.

3. Because the person walking in the middle of the road is not deaf and can hear the motorcycle coming and get of of the trajectory.
